Rental Contract Terms
1. Rules determine detailed provisions of car renting agreements within car rental agency, made between hiring person hereinafter referred to as Hirer, and Shipbuilding Solutions Sp. z o. o. Hereinafter referred to as Car Rental Agency.2. Car Rental Agency reserves itself the right to rent passenger cars only to people that fulfill the following conditions:
They are at least 25 years old.
They have valid identity card with registration of residence in the territory of Poland.
They have valid passport or identity card of the European Union country, if the person does not live in the territory of Poland.
They have valid driving license for at least one year.
They posses valid credit card for car rental payments.
3. The reservation made via Internet by Hirer shall be accepted by Car Rental Agency, provided that the following conditions are fulfilled:
Application form must include all data required by Car Rental Agency.
Expressing of Hirers consent to debit their credit card on down payment account for renting a car that is equivalent value for renting rate of a given class of car for 24 hours.
Fulfillment of conditions of the given Car Rental Agency Rules
Reservation must be done at least 48 hours before renting a car.
4. Cancellation of reservation:
To receive 100% of down payment refund, Hirer is obliged to notify Car Rental Agency at least 7 days before planned renting.
If the notification of resignation is received by Car Rental Agency within the shorter time than 7 days, or such information is not received by Car Rental Agency at all, the full amount of down payment is taken by Car Rental Agency as covering the cost of loss incurred.
5. Hirer is obliged to pay for renting in advance, for the whole duration of car renting agreement according to the rate binding on the day of renting. Hirer is obliged to pay amended rate in case when the agreement is prolonged and the amount due for renting the car before amendment was not be settle.
6. Rented car shall be driven only by person notified in the renting agreement and cannot be sub-rented by persons unmentioned in the renting agreement. In case of dispose of the car to a person unmentioned in the renting agreement, Hirer shall pay Car Renting Agency the fee in the amount of PLN 5000.
7. Driving beyond Polish borders is forbidden.
8. Within 24 hour rate of charge the limit of 300 km is obligatory, in case of exceeding the limit Hirer shall pay the fee in the amount of 16 gr for 1 kilometer.
9. It is forbidden:
To use rented cars in car races, raids and sports events.
Not to keep road safety and not to apply to traffic regulations, customs regulations and others.
To tow other cars.
To exceed the permissible load capacity.
To smoke cigarettes in rented cars.
To drive a rented car under the influence of alcohol or other substances that can affect awareness limitation.
10. In case when rented car is damaged or stolen Hirer is obliged to notify Car Rental Agency immediately on telephone no. 0694-497-156. In case of stealing the car by Hirer, Car Rental Agency shall charge Hirer with the amount of minimum PLN 20000.
11. In the period of renting the car, Hirer is obliged to everyday car service i.e. checking the oil state in the engine, cooling agent, windscreen washing liquid, air state in tyres, checking the driving lights, signalling lights and passing lights. In case of loss discovering, Hirer is obliged to complete the notified losses at its own expense.
12. Hirer is not authorised to order any repairs, modifications or any inspections of rented car. In case of replacing some parts or lack of them, damage of upholstery, Hirer shall incur the cost in amount of 200% of the part price in the authorized service garage.
13. Hirer is obliged to dispose rented car in order to make periodic inspection at the site and time agreed with Car Rental Agency.
14. Hirer is obliged to protect the car against theft (every-time locking the car and switching on all burglar alarm devices), the rented car shall be left for a night in the attended car park.
15. Hirer is financially responsible for any losses or damage arisen due to its fault or negligence.
16. For lack of first-aid kit, triangle, life jacket or extinguisher Hirer is charged with cost in the amount of PLN 200 for each item.
17. Hirer is responsible for lack of car parts and damage of wheels, mounting, radio installation, and committal of vandalism act.
18. Hirer is financially responsible for documents (registration book, OC insurance policy) alarm and keys of rented car. In case of getting lost of above mentioned items, Hirer shall be charged with cost in the amount of PLN 800.
19. Hirer is financially responsible for all road offences. Hirer is obliged to pay all fines imposed during renting a car. Administrative fee in the amount of PLN 300 shall be taken from Hirer in case of non-payment of the fine.
20. Hirer commits itself to return the rented car with the same fuel quantity as it was at the moment of renting. For missing litres of fuel Hirer shall pay the fee in the amount PLN 8 per 1 litre.
21. The car must be returned on time, with possible delay to 1 hour, in case of delay longer than 1 hour, Hirer shall pay the fee for the whole 24 hours of renting the car given. 22. Planned prolongation of car renting must be notified by Hirer at least 12 hours before deadline time of returning the car.
23. Arbitrary prolongation of car renting agreement by Hirer authorises Car Rental Agency to notify the police about the car theft, and to raise the rate of car renting of 300% for every 24-hour of arbitrary usage of the car.
24. In case of overdue payment of car renting fee, Car Rental Agency is entitled, without additional request to Hirer for payment and without indicating additional due date, to terminate the renting agreement with immediate effect and to charge Hirer with interests in the amount of 0,1% for each day of delay. In case of termination of car renting agreement by Car Rental Agency, Hirer is obliged to return the rented car immediately.
25. In case when Hirer does not return the car within the period determined by the agreement, Car Rental Agency is entitled to take back the car from Hirer and to charge Hirer with the amount of PLN 1000 +VAT for every car taken and with full cost related to the collection of the car given. 26. Guarantee deposit is refunded to Hirer at the moment of returning the car.
27. Guarantee deposit is not refunded to Hirer in case of replacing the car parts (car subassemblies) or occurred collision due to the fault of Hirer.
28. In cases unsettled by the present Rules, Civil Code regulations shall apply. All disputes arisen at the duration of this agreement shall be settled by the Court relevant for the seat of Car Rental Agency.
